This edited collection of eight original essays pursues the aim of bringing the spotlight back on Anton Marty. It does so by having leading figures in the contemporary debate confront themselves with Marty’s most significative contributions, which span from philosophy of mind, philosophy of language and ontology to meta-metaphysics and meta-philosophy. -/- The book is divided in three parts. The first part is dedicated to themes in philosophy of language, which were at the centre of Marty’s philosophical thinking throughout his (...) life. The second part focuses on the problem of the objectivity and phenomenology of time and space, upon which Marty was working in the final years of his life. The final part turns to Marty’s meta-metaphysical and meta-philosophical considerations. While being a crucial figure in the Brentanian School, Anton Marty did not receive the attention he deserves. This chapter briefly presents the aim of the volume: bringing the spotlight back on Marty and his most significant philosophical contributions with the help of leading figures of the contemporary debate. This chapter also offers an overview of the eight original contributions of the volume and its tripartite structure: Language and Communication, Ontology and Consciousness of Space and Time, Meta-metaphysics and Meta-philosophy.

Since the cessation of Mapuche guerrilla warfare against Chileans in 1881, machis who are predominantly women, have progressively incorporated aspects of traditional warring into their shamanic healing and performance of collective nguiUatun rituals. Guns, knives, war cries, and male pre‐war bonding acts are used by machis to "kill" or "defeat" illness, evil, and the effects of acculturation on their patients and the community. Acculturation is often seen by the Chilean Mapuche as the root of illness, evil, and alienation. All three (...) are conceived as enemies that threaten the Mapuche self from the outside and are detrimental to the physical and spiritual well‐being of the individual or group. While ritual played an important role in gaining supernatural help to strengthen warriors in the past, the warring complex in ritual, and healing in particular, is crucial in reinforcing contemporary Mapuche identity, traditions, and wholeness. I analyze the performance of spiritual warfare in healing and collective ritual as the Mapuche way of aggressively advocating the opposition between self, tradition, and life on one hand, and otherness, acculturation, and death, on the other. I analyze how machi discourse and practice of gender and identity contribute to feminist debates about gendered indigenous Others, and the effects that Western notions of Self and Other and feminist rhetoric have on Mapuche women and machi: people who heal with herbal remedies and the help of spirits. Machi juggling of different worlds offers a particular understanding of the way identity and gender are constituted and of the relationship between Self and Other, theory and practice, subject and object, feminism (...) and Womanism. This paper analyzes and compares the attempts at solving the paradox of non-existence put forward by Alexius Meinong and Edmund Husserl. It will be argued that Meinong’s solution is not convincing since he retreats from the field of predicate logic, in which the paradox arises, to a version of propositional logic. On the other hand, Husserl´s approach is more promising since he moves forward to an extension of predicate logic, in which judgments may be evaluated in relation to different contexts (...) or, in Husserl´s terminology, “spheres”. More precisely, to Husserl, existential judgments have to be interpreted as a kind of cross-sphere judgments, and thus existence fulfills a function loosely analogous to that of modal operators in possible-worlds semantics. La ética de Abelardo puede ser vista como el intento de confeccionar una doctrina de la conciencia moral. Tal intento fue en realidad un proyecto inconcluso en el que Abelardo pretendía demostrar a través de la dialéctica en qué consistía la auténtica moral cristiana sobre la base de su contraste con la tradición filosófica. Este artículo desarrolla las implicancias de ese proyecto desde tres perspectivas (1) situando la postura de Abelardo en el marco de la reflexión ética del siglo XII, (...) This article analyzes the conflict between traditional beliefs, cultural roles, and the search for individuality through the study of Fresia, a young Mapuche woman who renounced shamanistic practice. Her case demonstrates that the social transmission of traditional beliefs and symbols is not in itself enough to ensure the commitment of shaman/healers who must also internalize their cultural beliefs and attach personal meaning to them through their dreams, visions, and ritual practices. If this does not occur, as in Fresia's case, individuality (...) emerges and may contradict ideal cultural representations even in contexts such as that of the Mapuche where the concept of the person is inextricably bound up with one's role in the social system. Anthropologists who "study" religious practitioners are always confronted with both an ethical and a methodological problem. Our traditional training asks us to remain detached from our "informants" and their beliefs in order to collect "data" whose content will be analyzed according to academic agendas and theoretical trends, translated into anthropological jargon and published in ethnographies that will be accepted, published, and read in the academic world. On the other hand, the purpose of our anthropological research is to gain a deeper (...) understanding of the "other" from the "inside." Experiential anthropology has searched for a deeper understanding of religious practitioners and their beliefs. This includes focusing on native epistemologies and experiences and personal engagement with informants that sometimes involves the ethnographer's apprenticeship and initiation into the religious traditions that are beingstudied. This experience involves our commitment and respect towards those we study. Drawing on my own experience with Mapuche shamans in southern Chile I discuss the ethical and methodological problems anthropologists have in bridging professional interests with the personal commitments made with those whom we study. I discuss the ethical problems in using apprenticeship and initiation solely for professional purposes and the problem of cultural appropriation, the limitations that an exclusively academic model has on what can be written about, how it should be conceptualized, theorized, and represented, and the problems anthropologists undergo in having to simultaneously maintain professional detachment and be committed to those with whom we work. The dispute between the Fregean and the Neo-Meinongian approach to existence has become entrenched: it seems that nothing but intuitions may be relied upon to decide the issue. And since contemporary analytic philosophers clearly are inclined towards the intuitions that support Frege's approach, it looks as if Fregeanism has won the day. In this paper, however, I try to develop a compromise solution. This compromise consists in abandoning the assumption shared by both Fregeanism and Neo-Meinongianism, namely that the notion of (...) existence adds something to the content of a statement. To the contrary, we should think of existence as a redundant notion. In other words, I will argue that we should be deflationist about existence. Moreover, the kind of deflationism I propose relies on what I call the existence equivalence schema, a schema which follows the blueprint of the well-known truth equivalence schema. From such a perspective, we can say that Fregean philosophers rightly deny the status of a discriminating property to existence; and, conversely, Neo-Meinongians, too, rightly reject the view that existence is captured by quantification or expresses a universal property of objects. Finally, the argument that we should take a deflationist approach to existence builds upon an analysis of natural language (general) existential statements and their intuitive entailment-relations. What, however, has remained relatively unexplored are the modifications that have been introduced over the years into this theory by Brentano himself and by his student Anton Marty. These amendments constitute the focus of the present paper. As will be argued, only by making such changes can the weaknesses of (...) the first formulation of the theory be overcome. Moreover, as the final section of the paper attempts to show, these modifications may even trigger further steps towards what we might label a new Brentanian theory of judgment. (shrink)

The problem of existence is reputed to be one of the oldest and most intractable of philosophy: What do we mean when we say that something exists or, even more challengingly, that something does not exist? Intuitively, it seems that we all have a firm grip upon what we are saying. But how should we explain the difference–if there is any–between statements about existence and other, garden-variety predicative statements? What is the difference between saying that something exists and saying, for (...) instance, that something is red, heavy, soft, etc.? These questions provide the focus of the present study. In the first part, this study addresses those authors that have been most effective and influential at widening the gap between statements about existence and garden-variety predicative statements. These are David Hume, Immanuel Kant, Franz Brentano, and Gottlob Frege. According to this family of approaches, existence becomes something very different from a property of objects. In the second part, this study turns to more recent attempts that have moved in the opposite direction by trying to reduce existence to a–more or less–plain property of objects. The philosophers that are going to be discussed here are Alexius Meinong, Richard Routley, Terence Parsons, William Rapaport, Edward Zalta, and Graham Priest. Between the first and the second part, an extensive chapter is dedicated to the approaches to existence developed under the heading of free logics. Finally, the third part of this study develops a deflationist account of existence: We should abandon the assumption shared by all accounts discussed in this study, namely that the notion of existence adds something to the content of a statement. To the contrary, we should think of existence as a redundant notion. The advantage of this strategy is that it does not make it contradictory to say that something does not exist – a frequent upshot of the approaches discussed in the first part. At the same time, this strategy avoids the epicycles common to the approaches discussed in the second part, which are strictly linked to the reduction of existence to a property of objects. (shrink)

Una de las más célebres contiendas de la Edad Media es la que enfrentó en Sens (1140) a Pedro Abelardo y Bernardo de Claraval. El primero llegó a esa localidad como acusado; el segundo había reunido el concilio como acusador.

Pierre Olivier distinguishes between two radically different concep-tions of legal fictions: on the one hand, the conception of legal fiction developed by the commentators of the Middle Ages, which culminates in Bartolus’s defini-tion; on the other hand, the conception developed by the 19th Century German scholar Gustav Demelius, who was followed, among others, by Joseph Esser. The main difference between the two approaches is individuated by Olivier in the fact that, while the former consider legal fictions as essentially implying an (...) actual fic-tional element, the latter deny this. In other words, according to Demelius and those who follow him, the term “legal fiction” is a misnomer. In this article, I first provide an example of a legal fiction. In the second and third section, I rely on this example to analyze and assess the two competing accounts. Finally, in the fourth part, I advance a syncretistic account of legal fictions, which should thus point to a possible middle ground between the two competing positions. As it is often the case, there is probably some truth to both accounts; the problem – I will argue – is that both theories tell only a part and not the whole of the story. More precisely, it will be argued that legal fictions essentially involve the structure of “as if”-statements, and that the one-sidedness of the two competing accounts derives from the fact that one focuses too much on the “if”-component (the assumption), whereas the other focuses too much on the “as”-component (the comparison). In this paper, I analyse and compare Anton Marty’s and Alexius Meinong’s theories of judgement. There are at least two reasons speaking in favour of such a comparison. First, both philosophers were influenced by Franz Brentano’s approach to consciousness, in general, and by his theory of judgement, in particular: in differing degrees, Marty and Meinong may be considered pupils of Brentano. Second, the two philosophers introduced similar amendments to Brentano’s approach. According to Brentanian orthodoxy, we do not have access to (...) any entity that objectively grounds the truth of our judgements, whilst Marty and Meinong both commit themselves to the view that we do. This paper reconstructs the specific ontological characteristics of these entities and the kind of epistemological access we have to them. Finally, a crucial but problematic component of Marty’s and Meinong’s theories is addressed, i.e., the introduction of negative entities to ground the truth of negative judgements. (shrink)

In this paper, I focus on the fiction of the retroaction of the condition in contracts, a very old tool of law which may be traced back to Roman antiquity. In the first part, I introduce the notion of a contract with a suspensive condition, i.e. a contract whose efficacy is subordinated to a future uncertain event. As will be addressed in the second part, this kind of contracts is often linked to the fiction of the retroaction of the condition (...) (e.g. the French Code Civile 1179 and the Italian Codice Civile 1360): When the condition of the contract is fulfilled we should do as if the condition was fulfilled at the very time of the stipulation of the contract. In the third part, I turn to an attempt by the young Gottfried Wilhelm Leibniz to rationalize this fiction: Although – as every fiction – false, the retroaction of the condition allows us to reach true conclusions with respect to a deterministic metaphysics. Eventually, after having raised some objections to the Leibnizian account, I develop an alternative rationalization of the fiction: The fiction does indeed lead us to true conclusions because the same conclusions may be reached by relying on an equity-principle or, alternatively, on a merely possible yet expedient law. The starting point of this paper is an apparent contradiction, often pointed out by commentators of the Poetics. In his treatise on poetry, whose object is human action, why does Aristotle assign a major role to necessity, while in the Rhetoric and the Nicomachean Ethics he clearly states that in the field of human action there is no place for necessity but only for probability? One answer has been, that in the Poetics Aristotle refers to a weaker type of necessity, (...) which in the end is more or less the same as probability. The fact that Aristotle (the argument continues) speaks almost always not only of necessity but also of probability, is proof of this weakening of necessity. I argue, on the contrary, that in the Poetics necessity and probability are two distinct principles, which concern different aspects of the tragedy (i. e. the most accomplished poetical work according to Aristotle), and which therefore should not be blurred. The first step is to make clear that the alleged contradiction is only apparent. It is in fact true that in the world of action, according to Aristotle, there can be no necessity, but action is only the object of poetry and not poetry itself. Poetry as such is a technique, which differs from other techniques (like medicine) on account of its ends, and, consequently, also on account of its object. In the world of technique, as is clearly stated both in the Methaphysics and in the Posterior Analytics, there is necessity, in the sense that to reach this or that end you have – necessarily – to do this or that. But then – this is the second step – what is the relation between technical necessity and the principle of probability? Evidently probability concerns the world of action, the object of poetry. This brings me to the following conclusion: When Aristotle tells us that the aim of the poet is to say what is possible according to probability and necessity, he means that the poet should take probable actions as objects and use them as necessary means to reach a particular end. This end, in the case of tragedy, is the tragic plot. The two principles are then strictly connected (every moment of the tragedy has to be looked at from one side and the other), but nonetheless distinct. (shrink)

There is increasing interest in the EU about the central place of eIdentity (eID) in people’s lives. eID is increasingly seen as a bridge between the commercial viability of models based on large-scale provision of e-services and users’ need for privacy and security in online transactions. This paper examines technological, social and legal developments in the field of eID and asks whether there is the need for a new regulatory framework that both preserves users’ identity and enables the provision of (...) advanced services. Firstly, the paper interprets recent market moves in the eID field as a response to a rising regulatory tide. Secondly, it examines some of the challenges arising from Web2.0, and four emerging socio-legal issues associated with eID—behavioural profiling, social engineering, redlining and other unsocial practices. Thirdly, the paper examines the capacity of the current regulatory framework to absorb this turbulence, and finds it wanting. Finally, it advances a novel model of eID regulation that may help regulators create an identity-preserving, transaction-friendly eID environment. (shrink)

ABSTRACT In this paper we shall prove that l-rings are categorally equivalent to the MV*-algebras, a subcategory of perfect MV-algebras. We shall use this equivalence in order to characterize l-rings as quotients of certain semirings of matrices over MV*-algebras. We shall establish a relation between l-ideals in l-rings and some ideals in MV*-algebras. This edlows us to study the MV* f-algebras, a subclass of the MV*-algebras corresponding to the f-rings.

We introduce the notion of quantum MV algebra (QMV algebra) as a generalization of MV algebras and we show that the class of all effects of any Hilbert space gives rise to an example of such a structure. We investigate some properties of QMV algebras and we prove that QMV algebras represent non-idempotent extensions of orthomodular lattices.

We present a uniform version of Di Nola Theorem, this enables to embed all MV-algebras of a bounded cardinality in an algebra of functions with values in a single non-standard ultrapower of the real interval [0,1]. This result also implies the existence, for any cardinal α, of a single MV-algebra in which all infinite MV-algebras of cardinality at most α embed. Recasting the above construction with iterated ultrapowers, we show how to construct such an algebra of values in a definable (...) way, thus providing a sort of “canonical” set of values for the functional representation. In this paper we prove polyadic counterparts of the Hájek, Paris and Shepherdson's conservative extension theorems of Łukasiewicz predicate logic to rational Pavelka predicate logic. We also discuss the algebraic correspondents of the provability and truth degree for polyadic MV-algebras and prove a representation theorem similar to the one for polyadic Pavelka algebras.

In this paper we investigate the class of MV-algebras equipped with two quantifiers which commute as a natural generalization of diagonal-free two-dimensional cylindric algebras. In the 40s, Tarski first introduced cylindric algebras in order to provide an algebraic apparatus for the study of classical predicate calculus. The diagonal–free two-dimensional cylindric algebras are special cylindric algebras. The treatment here of MV-algebras is done in terms of implication and negation. This allows us to simplify some results due to Di Nola and Grigolia (...) :125–139, 2004) related to the characterization of a quantifier in terms of some special sub-algebra associated to it. On the other hand, we present a topological duality for this class of algebras and we apply it to characterize the congruences of one algebra via certain closed sets. Finally, we study the subvariety of this class generated by a chain of length n + 1. We prove that the subvariety is semisimple and we characterize their simple algebras. Using a special functional algebra, we determine all the simple finite algebras of this subvariety. (shrink)

In this paper we extend Mundici’s functor Γ to the category of monadic MV-algebras. More precisely, we define monadic ℓ -groups and we establish a natural equivalence between the category of monadic MV-algebras and the category of monadic ℓ -groups with strong unit. Some applications are given thereof.

We introduce a generalization of MV algebras motivated by the investigations into the structure of quantum logical gates. After laying down the foundations of the structure theory for such quasi-MV algebras, we show that every quasi-MV algebra is embeddable into the direct product of an MV algebra and a “flat” quasi-MV algebra, and prove a completeness result w.r.t. a standard quasi-MV algebra over the complex numbers.

The MV-algebra S m w is obtained from the (m+1)-valued ukasiewicz chain by adding infinitesimals, in the same way as Chang's algebra is obtained from the two-valued chain. These algebras were introduced by Komori in his study of varieties of MV-algebras. In this paper we describe the finitely generated totally ordered algebras in the variety MV m w generated by S m w . This yields an easy description of the free MV m w -algebras over one generator. We characterize (...) the automorphism groups of the free MV-algebras over finitely many generators. (shrink)

In “A new proof of the completeness of the Lukasiewicz axioms” Chang proved that any totally ordered MV-algebra A was isomorphic to the segment \}\) of a totally ordered l-group with strong unit A *. This was done by the simple intuitive idea of putting denumerable copies of A on top of each other. Moreover, he also show that any such group G can be recovered from its segment since \^*}\), establishing an equivalence of categories. In “Interpretation of AF C (...) *-algebras in Lukasiewicz sentential calculus” Mundici extended this result to arbitrary MV-algebras and l-groups with strong unit. He takes the representation of A as a sub-direct product of chains A i, and observes that \ where \. Then he let A * be the l-subgroup generated by A inside \. He proves that this idea works, and establish an equivalence of categories in a rather elaborate way by means of his concept of good sequences and its complicated arithmetics. In this note, essentially self-contained except for Chang’s result, we give a simple proof of this equivalence taking advantage directly of the arithmetics of the the product l-group \, avoiding entirely the notion of good sequence.
